This kind of picture should be uploaded locally when allowed, see fr:Wikipédia:Exceptions au droit d'auteur for the French WP exemption. This is a kind of "fair use" and is not ok on Commons, but it may or may not be ok on the local projects. --Eusebius (talk) 21:17, 5 April 2010 (UTC)Reply[reply]
I know that these are currently not allowed on commons and on fr the rule seems to be challenged. They would be ok on en (fair use) and de (Panoramafreiheit, Schutzlandprinzip). I was more looking for an exemption that would i.e. allow non-commercial use only or something like this, but I was unable to find even such a rule in the french law so far. There seems to be not even something that allows use of such images for news reports, which I can hardly believe. Still checking. --PaterMcFly (talk) 07:23, 6 April 2010 (UTC)Reply[reply]
There is indeed no copyright exemption in France for public non-commercial use. There are a few exemptions though, and news reports are covered under certain conditions (art. L122-5, 3° a et 9° du Code de la Propriété Intellectuelle). --Eusebius (talk) 08:16, 6 April 2010 (UTC)Reply[reply]
Hmm... That's what I was looking for. Stupid law, just not practicable. I need some time to study this in detail (my french isn't so good any more...)

Yes, stupid law, but, my opposition to whom? No (major) party seems willing to relax our copyright law, and we will soon be compelled by an international treaty (or a European Directive of the Council, if ACTA is not ratified) to strengthen it. I'm not very optimistic about that kind of things, photographer/user/general public lobbies aren't as influential as copyright holder lobbies. --Eusebius (talk) 12:42, 6 April 2010 (UTC)Reply[reply]
